Terms of Service
Effective: March 15, 2026
1. Agreement
By using DataCork Conduit ("the Service"), you agree to these Terms of Service. The Service is operated by DataCork AG, Canton Zug, Switzerland.
2. Service Description
Conduit provides programmatic VPN access via WireGuard protocol through REST API, MCP (Model Context Protocol), and x402 micropayment interfaces. The Service provisions ephemeral VPN tunnels on demand.
3. Account Registration
You must provide a valid email address to create an account. You are responsible for all activity under your account and API keys. Keep your API keys confidential.
4. Acceptable Use
You must comply with our Acceptable Use Policy. Violations may result in immediate account suspension.
5. Payment Terms
- Free tier: 100 API requests per month, 5 concurrent sessions. No payment required.
- Subscription plans: Billed monthly via Stripe. You may cancel at any time; access continues until the end of the billing period.
- x402 micropayments: Pay per-request via USDC on Base. Payments are final and non-refundable.
- Bitcoin: Invoices expire after 1 hour. Payments require 3 confirmations. Exchange rate locked at invoice creation.
All prices are in USD. Swiss VAT may apply where required by law.
6. Service Level
We target 99.9% API uptime (excluding scheduled maintenance). VPN node availability depends on third-party infrastructure providers. We do not guarantee specific throughput or latency.
7. Intellectual Property
The Service, its code, documentation, and APIs are the intellectual property of DataCork AG. You may use the API according to these terms. You may not reverse-engineer, decompile, or create derivative works of the Service.
8. Limitation of Liability
To the maximum extent permitted by Swiss law, DataCork AG’s total liability for any claim arising from use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages, loss of profits, or loss of data.
9. Termination
Either party may terminate this agreement at any time. You may delete your account via the API or by contacting support@datacork.com. We may suspend accounts that violate these terms or the AUP.
10. Governing Law
These terms are governed by the laws of Switzerland. Disputes shall be resolved in the competent courts of Canton Zug, Switzerland.
11. Changes
We may update these terms with 30 days’ notice via email to registered users. Continued use after the notice period constitutes acceptance.
